Apothisoeurs, registered with the Trade and Companies Register (RCS) under number 942 525 080, is a sole proprietorship managed by Léa Vandewalle, with its registered office at 43 rue des Tourterelles, 59240 Dunkirk, France.

Acceptance of the General Terms and Conditions of Sale
These General Terms and Conditions of Sale ("GTC") define the rights and obligations of Apothisoeurs and any buyer placing an order on the website www.apothisoeurs.fr.
By confirming their order, the Client acknowledges having unreservedly accepted these GTC and declares that the purchase of Products on the website www.apothisoeurs.fr is for strictly personal use, and that they have full legal capacity to agree to these GTC.
The applicable GTC at the time of the order are available on www.apothisoeurs.fr and may be consulted at any time.
The GTC take precedence over any other document.

Modification of the General Terms and Conditions of Sale
Apothisoeurs reserves the right to modify these GTC at any time, particularly to comply with legislative or regulatory changes.
In case of modification, it is the Client’s responsibility to review the GTC before placing any order on www.apothisoeurs.fr.
Definition of the Parties
In these GTC, "Apothisoeurs" refers to the seller, "the Client" refers to non-professional buyers, and "Products" refer to items offered on the website www.apothisoeurs.fr.
Geographical Scope
Products shown on www.apothisoeurs.fr are intended for residents of France (mainland and overseas territories) and European Union countries. If ordering from a country other than France, the Client acts as the importer of the concerned Products.
Any applicable customs duties for shipments outside the European Union are the sole responsibility of the Client.
Products
Apothisoeurs offers handmade scented candles and related accessories for sale.
The Products offered are those listed on the website www.apothisoeurs.fr and indicated as sold and shipped by Apothisoeurs.
The main characteristics of each Product (composition, precautions, etc.) and the related photos are available on the respective product page on www.apothisoeurs.fr. They aim to be as accurate as possible. However, Apothisoeurs cannot be held liable for any presentation errors or omissions.
The choice and purchase of a Product are the sole responsibility of the Client.
Products are available while stocks last as shown at the time of ordering on www.apothisoeurs.fr.
Prices and Payment
Prices are listed in euros and VAT-exempt under Article 293 B of the French General Tax Code (micro-enterprise regime).
Apothisoeurs reserves the right to change prices at any time, but products are billed based on the rate in effect at the time the order is recorded on www.apothisoeurs.fr.
Prices may include discounts granted by Apothisoeurs during specific periods on the site. These prices are fixed and non-revisable only during their validity period.
Prices do not include processing, shipping, or delivery costs, which are added at checkout.
Shipping fees are specified before order confirmation. The total amount due includes product and delivery costs.
Payment is made by credit card or Apple Pay via the secure Mollie platform. Payment information is encrypted to ensure transaction security. Full payment is required upon ordering to process it.
Apothisoeurs reserves the right to withhold delivery of ordered Products if full payment has not been made.
An invoice is issued by Apothisoeurs and provided to the Client upon delivery.
Order
It is the Client's responsibility to choose the Products on www.apothisoeurs.fr under the following conditions:
The Client selects the products and adds them to the cart, then completes the checkout form. The information provided (name, address, delivery method, payment confirmation) must be accurate and complete to ensure proper delivery. The Client must verify the accuracy of the order and promptly report any errors.
The order becomes effective upon receipt of payment.
The sale becomes final once:

The Client receives a confirmation email from Apothisoeurs summarizing the ordered products, prices, and delivery address.

The full payment has been received by Apothisoeurs.
The Client will receive a tracking link via email after order validation. In case of issues, they may contact us via the "Contact" section on www.apothisoeurs.fr.
Apothisoeurs reserves the right to block any order until the issue is resolved in cases such as payment failure, incorrect address, etc.
Apothisoeurs may refuse an order for justified reasons, including payment disputes, suspected fraud, or stock issues.
Reminder: Placing an order implies acceptance of these GTC, the prices, and the product descriptions. Any order placed on www.apothisoeurs.fr constitutes a distance sales contract between Apothisoeurs and the Client.
Delivery
Apothisoeurs offers several delivery options when ordering on www.apothisoeurs.fr. Products are delivered to France and EU countries. Delivery times and fees are shown before order confirmation and vary depending on destination and carrier.
Delivery fees are fixed, and the Client is responsible for providing a complete and accurate delivery address.
The indicated delivery time is for reference only and not guaranteed. Apothisoeurs will do its best to ship the products promptly. In case of delay, the Client will be notified via email.
Deliveries are handled by independent carriers (chosen by the Client during checkout). Therefore, delays due to the carrier or force majeure cannot result in:

Apothisoeurs is not responsible for items lost or damaged during transport.
The Client must inspect the Products upon delivery. If an item is damaged or unusable due to transport, the Client must report it promptly, specifying the issue and providing photos (shipping box, product packaging, and product).
Such claims must be confirmed in writing (email or letter) within 5 days of delivery. Without notice within this period, products are deemed accepted, and no claims will be honored.
Risk transfer (loss or damage) occurs upon physical receipt of the Products by the Client.
If an item is missing upon delivery, notify Apothisoeurs the same day or the next business day at apothisoeurs@gmail.com. You will be required to sign a sworn statement.
Claims made beyond this timeframe will not be considered.
If a product is defective or non-compliant, Apothisoeurs will replace or refund it once the issue is verified, in accordance with Articles L.217-4 and following of the French Consumer Code and these GTC.
If the Client has selected their own carrier, risk transfer occurs upon handover of the package to that carrier.
In case of lost or stolen parcels, Apothisoeurs will handle the claim with the carrier. If the parcel is recovered in good condition, it will be reshipped. If declared lost, the Products will be reshipped (subject to availability). Unavailable items will be refunded.
Any return of undelivered parcels will require the Client to pay new shipping fees before reshipment.
Right of Withdrawal and Returns
In accordance with Article L.221-18 of the Consumer Code, the Client has 14 days from receipt of the Products to exercise the right of withdrawal. Returned items must be unused, in their original packaging, and in resalable condition. Damaged, incomplete, or soiled items will not be refunded.
Failure to meet these conditions will void the right of withdrawal.

Return shipping costs are the Client’s responsibility. The Client must retain proof of shipment. If the parcel is lost during return and no proof is provided, no refund will be issued.
Refunds are made within 14 days of receiving the returned products.
Customized, opened, or discounted items are not eligible for withdrawal.
Legal Warranties
Apothisoeurs Products are covered by legal warranties of conformity (Articles L.217-4 and following of the Consumer Code) and against hidden defects (Articles 1641 and following of the Civil Code).
In case of non-conformity or hidden defect, the Client may return the product to Apothisoeurs for exchange or refund. Claims must be sent by email to apothisoeurs@gmail.com within 30 days of delivery.
Liability
Apothisoeurs cannot be held responsible for damages due to misuse or indirect losses (profit, data, etc.).
In any case, Apothisoeurs’ liability is limited to the order value.
The content (descriptions, photos, etc.) on the website is provided without guarantees other than those required by law.
Apothisoeurs is bound only by a best-efforts obligation in the distance selling process. It is not liable for damages resulting from internet use, including data loss, intrusions, viruses, or service interruptions.
Apothisoeurs is not liable for:

Non-compliance with the laws of the delivery country (the Client is responsible for verifying compliance).

Misuse, negligence, improper maintenance, or normal wear.

Accidents or force majeure events.
Apothisoeurs’ warranty is limited to the replacement or refund of defective or non-compliant Products.
Personal Data
Client data is processed in accordance with our Privacy Policy. Apothisoeurs will never sell or share personal data without the Client’s consent, except as required by law.
Data is used only for order processing and delivery, involving Apothisoeurs and third-party partners (carriers and payment providers).
In accordance with Law No. 78-17 of January 6, 1978, users have the right to access, modify, or delete their personal information. Requests may be made at any time via email to apothisoeurs@gmail.com.
Stored data serves as proof of transactions and is retained for 5 years, the legal limitation period for contractual liability.
Intellectual Property
All elements of www.apothisoeurs.fr (texts, images, logos, and graphics) are the property of Apothisoeurs and are protected by intellectual property laws.
Any total or partial reproduction is strictly prohibited.
Applicable Law and Dispute Resolution

These GTC are governed by French law. In case of disputes, efforts will be made to reach an amicable resolution. Failing that, the matter will be submitted to the competent French courts.
Clients may also seek consumer mediation in case of unresolved disputes.
Force Majeure
Apothisoeurs cannot be held liable for failure or delay resulting from force majeure events such as strikes, natural disasters, or health crises.
